1. Acceptance of Policy

1.1. SkillPublic Inc (‘Beautster as its trade name’) is responsible for processing your personal data obtained through https://www.beautster.com (‘Platform’). Beautster is committed to protecting the privacy of all users (Customer and Businesses) and visitors of the Platform and/or using its provided services.

1.2. Beautster complies with all applicable laws and regulations regarding the Personal Information Protection and Electronic Documents Act (PIPEDA). The personal data provided by users and/or visitors will be treated confidentially.

1.3. By visiting this Platform and/or using its provided services, you agree and give consent to the processing, use, and/or transmission by Beautster of your personal data as described in this Privacy & Cookies Policy (P&C Policy). If you do not agree to the terms of this P&C Policy, please do not use this Platform and/or our services.

2. Processing your data

2.1. When you register yourself as a user of this Platform and create a user account and/or make a booking, you will be asked to provide information about yourself including your name, e-mail address, phone number, postal address, credit card information. This personal data is securely processed by Beautster and used for the administration and operation of the Platform, our services and the services provided by the Business, to whom Beautster is allowed to transfer the information provided.

2.2. In addition, Beautster may also keep track of general (non-personal) (visitor) data on this Platform as well as data a user voluntarily provides to Beautster (including reviews, feedback and/or other information posted on the Platform, messages to Customer Service and/or e-mails).

3. Use of your information

3.1. Beautster takes security very seriously. Beautster agrees that you or your customers' data is your data and not Beautster's data and it will not be shared with anyone or any third parties.

3.2. Beautster agrees under no circumstances, to contact or solicit the existing clientele of the salon Business, present within the client list, unless it is on the behalf of the salon Business, via transactional or marketing communication, or the customer also has an active Beautster marketplace account.

3.3. Your (personal) data will enable Beautster to provide you with access to the relevant parts of the Platform and supply you with the services you wish to use. It will also enable Beautster to send booking confirmation to you and to contact you where necessary concerning its or Business´s services. Beautster uses your (personal) data for the administration, the processing of your bookings and administration, support, improvement and further development of (the design of) this Platform and our services. Beautster will also use your (personal) data for statistical and/or analytical purposes (including the click and visitor behaviour on this Platform).

3.4. Beautster may use your personal data to contact you (by e-mail or phone) and ask for your opinion on the Platform and/or the services and to notify you about important developments and changes to the Platform and/or the services.

3.5. Where you have indicated accordingly, you agree that Beautster may also use your personal data to contact you (by phone, mobile messaging (SMS, MMS, etc.) and/or by e-mail) and let you know about other products and/or services that may be of interest to you.

3.6. Where you have indicated accordingly, you agree that Beautster may also share your personal data with third parties (carefully selected by us) so they can contact you (by phone or mobile messaging (SMS, MMS, etc.) and/or by e-mail) about certain products and/or services that may be of interest to you.

3.7. In order for Beautster´s or Business´s services to be provided, you agree that Beautster has the right to transfer to the Business and to the payment service provider (Stripe Inc.) the information provided to it.

3.8. You can always object to the use of your personal data as described above in articles 2.2 – 2.5 and/or withdraw your consent. You can do so by contacting Beautster (use the contact details set out in article 8).

3.9. Recipients who no longer wish to receive Beautster´s newsletter or promotional emails can click a link called “UNSUBSCRIBE”, which is included in all emails sent from Beautster.

3.10. The use of your personal data is limited to the time necessary to comply with the duties provided by the applicable law.

4. Disclosure of your information

4.1. Beautster is part of the SkillPublic Inc. The personal data you provide to us will be stored on Beautster´s servers in Canada or [other]. Access to your personal data is restricted to Beautster staff members and staff members of companies within the SkillPublic Inc. who act for Beautster for the purposes set out in this P&C Policy or for other purposes notified to you from time to time in this P&C Policy.

4.2. The personal data you provide to Beautster may also be shared with third parties who act for Beautster for the purposes set out in this Privacy Policy and for the necessary administration and implementation of this Platform and/or the services. Your personal data may be made available to Beautster´s data processing centers, IT service providers and/or other third parties for the administration, handling, and processing of the bookings you placed, the (credit card) payments carried out through the Platform and/or support services. By providing Beautster with your personal data, you agree to such a transfer to and use by third parties. Beautster will always take steps to ensure that your personal data is treated in accordance with this P&C Policy and that such use complies with all applicable laws and regulations.

4.3. Beautster reserves the right to share your personal data, if (i) it is under a duty to comply with laws and regulations (ii) it is necessary to enforce Beautster´s General Terms and Conditions and any other agreement (such as the Business’s agreement and/or the Salon management software agreement), or (iii) to protect Beautster´s rights whatsoever.

5. Cookies

5.1. Cookies are small (text) files stored on your computer. Beautster uses cookies through this Platform. Unless you set your browser to refuse cookies, Beautster´s system will issue cookies to your computer when you use this Platform. Cookies make it easier for you to log in on this Platform and use this Platform quicker and more efficiently. Beautster uses cookies to monitor the data traffic and further personalize the content of this Platform for you. Be sure your browser settings are currently set to accept cookies only after confirmation or to completely refuse cookies. Please realize that when you set your web browser as such, you are unable to (fully) use some features of this Platform. Advertisers can also use cookies on or through this Platform. However, Beautster does not control this. Cookies do not contain confidential information such as your name, home address, phone number and/or credit card or payment details. Beautster does not share cookies with third party websites and/or external data suppliers.

5.2. Your web browser also generates other information, including the language of the Platform you visited and your IP address. Your IP address is automatically stored on Beautster´s servers and used by it to collect visitor data from the Platform. Beautster uses visitor´s data for statistical analyses of the visitor and clicks behaviour on this Platform and for the optimization of the design of this Platform and its services. Beautster will not use your IP address to identify you in any way.

5.3. Beautster uses cookies only for the duration of your visit to this Platform unless you refused the use of cookies or limited the use of cookies as mentioned above under 4.1.

6. Security and data retention

6.1. Beautster takes steps to protect your personal data from unauthorized access and against unlawful processing, accidental loss, destruction and/or damage.

6.2. Where you have chosen a password which allows you to access certain parts of this Platform, you are responsible for keeping this password confidential. We advise you not to share your password with anyone and to change it on a regular basis.

6.3. Unfortunately, certain risks are always involved in the transmission of information and the processing of personal data through the internet and it is not completely secure. Although Beautster will take steps to protect your personal data, Beautster cannot guarantee the security of your personal data transmitted through this Platform; any transmission is at your own risk. Once Beautster has received your personal data, it will use strict procedures and security measures to try to prevent unauthorized access.

6.4. You may at any time remove your user account.

7. Accessing and updating

7.1. You have the right to gain access to the personal data registered with Beautster (“Access Request”). You can request Beautster to provide you with the (personal) data. If you wish to do this, please contact Beautster using the contact details set out in article 8.

7.2. To make sure that the (personal) data you entered is completely accurate and up-to-date, you can always examine it and make any changes if necessary.

8. Changes to our Policy

8.1. Beautster reserves the right to make changes to this P&C Policy. Any changes to P&C Policy will be posted on the Platform. We recommend you check this P&C Policy from time to time for the current version of Beautster’s Privacy Policy.
